Persbericht aangaande Harry Bout


In de zaak van Harry Bout, een Nederlander die al 21 jaar vastzit in Michigan, de VS, op verdenking van moord, heeft de Hoge Raad van Michigan besloten geen heropening van zijn zaak te geven. De rechter achtte het niet voldoende bewezen dat een internationaal verdrag was geschonden.
De uitspraak werd op 29 augustus gedaan in het Hoge Gerechtshof in Lansing, de hoofdstad van Michigan.

Hiermee is de zaak van Harry Bout voor de Staat Michigan afgesloten. Een volgende stap zou het federale hof (US Supreme Court) zijn. De Nederlandse advocaat van Bout, mr. G.G..J. Knoops, acht een kans mogelijk om de schending van het internationale verdrag van Wenen aan te vechten.

Andere mogelijkheden, zoals terugkeer naar Nederland onder het WOTS-verdrag, moeten nu weer bekeken worden. Ook behoren diplomatieke oplossingen tot de mogelijkheden die bekeken kunnen worden, aldus de Amerikaanse advocaat van Bout, mr. J. Lawrence te Detroit.

De Free Harry Bout Support Groep, bestaande uit Sandra uit Hoogeveen en Annabelle uit Amsterdam, zegt door te gaan met de ondersteuning en te blijven fondsenwerven voor eventuele kosten van een zaak voor de US Supreme Court.

De uitspraak kwam niet geheel onverwacht, want de Hoge Raad in Michigan had nog nooit een zaak als deze laten heropenen. Het was een noodzakelijke stap om verder te komen, aldus de supportgroep. “Veel mensen hebben bijgedragen in de kosten van de stap naar de Hoge Raad, en we gaan ervan uit dat dit een stap op weg naar de rechtvaardigheid voor de zaak van Harry Bout is.”

Harry Bout in De Volkskrant

De correspondent van De Volkskrant in New York is naar Michigan geweest om onder anderen met Harry Bout te praten - de langst vastzittende Nederlander in het buitenland, en op valse gronden zoals hier wel eerder besproken. Ik kan slechts verwijzen naar de papieren editie van maandag 28 augustus, het artikel komt vermoedelijk niet op het net.
Voor wie de notities hier en op Freeharrybout.org [met verdere verwijzingen] heeft gelezen staan er niet veel nieuwe dingen in. Correspondent Van Hoogstraten laat ook de advocaat, een getuige à décharge en de officier van justitie Varis Klavins aan het woord. Deze laatste laat zich kennen: hij lijkt volkomen gemotiveerd door een persoonlijke rancune tegen degene die hij levenslang heeft laten opsluiten. Toch wel opmerkelijk, want dat moet deze figuur met meer mensen gedaan hebben. Van Hoogstraten heeft het door Klavins bewaarde dossier-Bout gezien en stelt droogjes vast dat hij er een bedankbriefje van de echte moordenares Dawn Bean in aantrof.
Over Cecil McKinney, een vriend van de moordenares: "In 2003 heeft hij onder ede gezegd dat ze de moord tegenover hem bekende. Zij was een racist, zegt McKinney. Ze droeg een .32-kailber pistool bij zich - het moordwapen - en schepte op over de schietpartij."
McKinney is naar mijn weten niet vervolgd wegens meineed.
Nog iets wat mij hetzij ontschoten is voor de reconstructie van de avond van de moord en de nasleep, of Harry heeft het niet verteld: de auto van het slachtoffer is naar het vliegveld van Indianapolis gereden om de indruk te wekken dat hij het land verlaten had. Dat klopt - dit heeft dawn Bean gedaan, maar dit vermeldt de Volkskrant niet.
Advocaat Lawrence schat de kansen in de hoogste-instantie-procedures niet hoog. En gratie "ligt evenmin voor de hand. 'Een wegens moord veroordeelde man laten gaan', weet Lawrence, 'is politiek niet echt verstandig'."
Hier klinkt de politiek van de VS als gesticht weer door. Als Harry Bout niet de moordenaar is laat gouverneur Granholm van Michigan de echte moordenaar vrij rondlopen. Mij dunkt dat deze mevrouw soft on crime is.

Voor wie de papieren versie van De Volkskrant na dezen ter hand neemt (Tussen criminelen, p.9): de foto van de gevangenis van Carson City is genomen in de nor van Carson City in Nevada. In The Land of the free zijn veel gelijke plaatsnamen en zit een op de honderd mensen achter slot en grendel, dus de vergissing - het is trouwens een mooie foto - is begrijpelijk. In Carson City Michigan zijn de deuren massief.
En de liefste wordt "een Amsterdamse vrouw" genoemd. Daarbij denk je als snel aan iemand die even van achter de tobbe vandaankomt om een gevangene te redden. Tja, De Volkskrant als stilistisch hoogstandje - enfin, de bovengeciteerde zinnen spreken al voor zich.

More on Steven Stewart, at the mercy of Wisonsin DOC

Steven Stewart was going to have a trial date on the 24th August for his case
against the abuse he suffered at WSPF of the hands of some guards, but they
upped the date to August 21st (so no one would be there? - makes you wonder) and he lost his case of abuse/beating (at WSPF). Afterward the judge gave him one call.
He called his mother with the news of what happened after an interview
with the head of DOC health (Mr Greer), the doctor of the facility, the
nurse and several prisoner supporters, and Steven's mother on Tuesday 15th
August:

  • Immediately after the group of prisoner supporters left the meeting,
    Steven was demoted to bottom level - no calls, no tv etc.; during the
    meeting it was revealed that Steven had been on 'Level 2' of privileges, but
    he was held at Level one (less privileges).

  • The doctor of the facility is refusing to treat him until he
    apologizes for what he said during the conference. Steven called the doctor
    a liar and there was a general shouting match - the doctor acted really
    arrogantly according to the supporters.

  • Steven said they are not delivering mail from a female friend from
    Europe to him - they say she is his girl friend. They are putting her mail to
    him in his property. But he will not get his property, because he is in ad seg (detention in complete isolation). Of this facility, one does not get his property until one is moved to general population, and since Steven is actually a supermax prisoner, only held there because he needed medical treatment (!), there is no end in sight of the isolation-practices of the DOC.


  • Steven was going to be punished for what he said - false pretences - they
    just used the group of supporters and his mother to get his catheter
    changed as Steven has gotten to mistrust them.

    An American Supermax nightmare


    In a restaurant in Milwaukee, a long time ago, Steven D. Stewart was attacked by a man with a knife. Like so many US citizens he carried a gun and he shot the man. For an African American man, such an act is never justified self-defense. He is in prison, and he is made to know.

    From 1999, Mr Stewart was held in Wisconsin Secure Program Facility (WSPF), a so-called “supermax” prison in Boscobel, where one is taken for the most dangerous man in the world. He was held there, because the prison had to be filled up: he never had any write-ups or complaints in the previous years of detention. You, reader, heard about this prison before, amongst others when guards wanted to beat up Lornell Evans, because of prolongued disobedience (he refused to eat); that he did not eat is true: he had died of neglected aftercare of his cancer-operation (October 2005).

    On February 22nd, Mr Stewart was operated on one of his many complaints and illnesses: Rectal Prolapse, a serious bowel disease. Mr Stewart still had complaints after that, and he asked for help. Instead, guards beat him up (March 8th). This resulted in his whole operation becoming undone. After more exams it turned out that he had Multiple Sclerosis. The Doctor of the Department of Neurology at the University of Wisconsin Hospital in Madison, Dr Brooks, said Stewart had a problem "much worse than multiple sclerosis" and needed treatment "asap". The head nurse at WSPF, Cindy Sawinsky, did not give that information to the warden nor the head of the DOC, Mr Matthew Frank. A MRI x-ray taken on April 13th showed that something was on both sides of Mr Stewart's spine, according to the hospital doctor. The prison staff said: "There is nothing wrong with your spine, you only have hemorrhoids." This is being denied by the hospital doctors.
    The incident when Mr Stewart was beaten up on March 8th was completely recorded on video. The guards can make up an excuse why they attacked a sick prisoner, they will say for example that he bit them. He was placed in a solitary cell with no property, and what is called “back of cell restriction” for 15 days. This means that the prisoner is made to kneel down with his hands behind his back at the end of the cell, when something (medicine, food) is given to him through the food slots in the doors.
    The same sergeant, Hassell, beat up Mr Stewart at the UW Hospital in Madison, Wi on April 5th, 2006. He was a few minutes from surgery, they brought him back to the Boscobel supermax without him getting his surgery repaired. The next day, April 6th, 2006, Mr Stewart passed out on the floor. He was taken to the Boscobel hospital by paramedics. When he was stable enough to leave there he was walked out of hospital naked: no clothes, shoes, socks or underwear. He had to walk on the cold ground barefoot.

    On June 5th, Steven Stewart was transported to Waupun Correctional Institution, a maximum security prison. He was taken to the administrative segregation unit (the hole), where unclean cells, often still smeared with faeces of previous inhabitants house the severely ill patient Mr Stewart has become. He lost many stones in weight, and up to now his urinary drain has not been changed. He is able to do it himself, but they won't let him. They say he refuses to have it changed. For what reason? Apart from MS, he suffers from bleedings from the prolapse and now he has an urinary infection, hernia in his back and a lump in his abdomen.
    How much longer does a sick person have to suffer in Wisconsin's prisons?

    A few months ago we asked the readers of the SF Bay View if they would send him a greeting card, to boost his morale. He really appreciated the gesture and the colorful cards, and it helped him stay focused and hopeful that there are still decent people around.

    In August 2006 Stewart may come up for parole. It would be good if he could be relieved from being subjected to care for his health which he thinks inappropriate - apart from being out of the prison anyway.
